LEGAL NEWS

The Epidemic Diseases (Amendment) Bill, 2020 was passed by the Rajya Sabha on Saturday, September 19, 2020

The Rajya Sabha on September 19, 2020 cleared the Epidemic Diseases (Amendment) Bill, 2020 which is already in force as an Ordinance, via voice vote.

The Bill sought for the protection for healthcare personnel combating epidemic diseases and also expands the scope of powers of the Central Government to prevent the spread of such diseases.

In relation to the Bill, the Health Minister Dr. Harsh Vardhan further stated that the Bill provided provisions in cases where there were instances of attack on the person, property of the healthcare service personnel and the healthcare facility.

The Kerala HC remarked that there is nothing wrong if the rape accused is restricted from using social media to protect victim’s privacy

While granting bail to a rape accused, the Kerala HC remarked that;

“Heavens will not fall down if a condition is imposed in a bail order restraining the accused in a rape case in using social media, especially when it is to protect the victim girl’s privacy.”

The Gujarat HC ruled that a person can be arrested for any cognizable offence committed under the Customs Act, 1962 by a Customs Officer without complying the provisions of Sections 154 to 157 of the Cr.P.C.

The judgment delivered by the Gujarat HC states that the Section 104 of the Customs Act, 1962 empowers the Customs Officer or the Directorate of Revenue Intelligence (DRI) to arrest any person on the basis of suspicion of smuggling.

The Court further declared that the power to arrest a person by a Customs Officer is statutory in nature and ordinarily should not be interfered with by the court unless certain special circumstances tend to arise.

It was further held that while performing such an arrest, the Customs Officer or the DRI need not to follow the provisions of sections 154 to 157 of the Cr.P.C. (Information to the Police and their Powers to Investigate).

The Patna HC directs the State to ensure immediate relief to the children in Bihar and therefore ensure their basic FRs

Owing to the problems faced by the children in the District Bhagalpur, Bihar due to non-availability of mid-day meals following shutting of schools and Anganwadi centres amid the COVID-19 pandemic; the Patna HC on 6th July, 2020 had taken suo moto cognizance in the case.

Accordingly, viewing the vulnerable situation of children in this crisis time; the Court held that it is the moral and legal obligation of the State, under the constitutional provision and international treaty obligation to ensure proper Right to food ensured under Article 21 of the Constitution to the children and their families.

The Court further directed the State to ensure proper access to online education in pandemic time also by the children, especially those belonging to BPL, under Article 21A of the Constitution and Articles 41 and 45 (DPSP) of the Constitution.

The Karnataka HC issued a modified Standard Operating Procedure for reopening of District/Trial Courts

As per the revised SOP, 55 Taluka Courts will reopen from September 28, 2020.

In accordance with the directions of the Karnataka HC, the District and Trial Courts in the state will reopen from September 28th in a phased manner following the SOP in order to control the spread of COVID-19.

The BCI writes to the Madras HC to recall the Madras High Court Designation of Senior Advocates Rules 2020

The action comes as a result after the release of notification by the Madras HC to start the process of inviting applications for Senior Advocate designations.

Following resentment among the Legal Fraternity against the proposed process, the Bar Council of India wrote a letter to the HC’s Chief Justice, AP Sahi for the revival of the Madras High Court Designation of Senior Advocates Rules 2020.
