LEGAL NEWS

Owing to some officials of the HC testing positive for COVID-19, the Orissa HC will be closed on 21st and 22nd September

Pertaining to the threat of the spread of the coronavirus after some of the officials of the Orissa HC and its offices have tested positive for the novel coronavirus, the Orissa HC has released its notification directing the closure of the HC along with its offices on 21st and 22nd September.

The direction comes in lieu of carrying out “extensive sanitization” process in the entire premises of the HC Building.

It was further notified that the pending case lists of both the days will be further dealt on 23rd September after the reopening of the HC.

The BCI requests the Central Government to ensure confidentiality of attorney-client communication

The action comes in lieu of data protection of attorney-client communication which is at risk due to the process being carried on video-conferencing apps due to the current dazzling situation of COVID-19 pandemic.

The said decision was made while considering the representation in the case of Akhil Hasija v. Bar Council of India. The BCI further requests the Central Government to specify applications for video-conferencing apps to ensure the confidentiality of the data.

According to the report released by the Union Ministry of Law and Justice, around 51 lakh cases are pending in various Indian HCs and around 3.5 crore cases in Indian lower Courts :

The data released by the Union Ministry of Law and Justice accounts that over 51 lakh cases (51,52,921) are pending in various HCs across the country and almost 3.5 crore cases (3,44,73,068) are pending in lower Courts of the country.

The data has gone up in wake of the COVID-19 pandemic.

The Karnataka HC seeks answer from the State Government that whether the Claims Commissioner appointed for the Bengaluru riots case is empowered with the powers under Commission of Inquiry Act

The Karnataka HC on August 28 had appointed Retired Justice H.S. Kempanna as the Claims Commissioner to investigate and estimate the damages caused due to the Bengaluru riots.

The question asked by the Court to the State Government was that whether the Claims Commissioner should be empowered with the powers as prescribed under the provisions of the Commission of Inquiry Act.

The Delhi HC observed that a writ petition including an industrial dispute shall not be listed unless it discloses “exceptional circumstances” in the synopsis and in its opening paragraphs.

The State Government approved the creation of 1,000 bed capacity Covid-19 care centre at indoor stadium in Nagpur following the Bombay HC’s rebuke

In a previous hearing where the Bombay HC asked the State and the Municipal Corporation to place the detailed plan on record within two weeks relating to the proposal of the Court for the creation of 1,000 bed capacity Covid-19 care centre at Mankapur indoor stadium in Nagpur, the State Government did not respond to the proposal.

The Court lashed out at the State Government for not responding to the proposal of the Court. In lieu of the above rebuke from the Court, the State Government approved the proposal and thereby informed the Bombay HC.

SC says that ‘right to protest’ needs to balance with ‘right to movement’ in Shaheen Bagh case

In the case of Shaheen Bagh who was protesting against the citizenship act with the group, it was said that they were blocking the roads and creating traffics. The Supreme Court held that, there must be a balance between the right to protest and right to movement in public. Due to pandemic outbreak later, they were removed from the protest.

They wrote the letter to CJI regarding the forceful removal. After that the Solicitor General held that the protesting is not an absolute right and the peaceful protest can be permitted and it should be balanced with the right to movement.
